Ted has a broad civil litigation advocacy practice and focuses on the protection and enforcement of individual, contractual and property rights. He has extensive experience in personal injury and wrongful dismissal claims, contractual and commercial disputes, and estate litigation.

In focusing on what is in the best interests of his clients, Ted deciphers how to effectively resolve the legal issues at hand. While Ted is an accomplished trial lawyer, having appeared before all levels of the courts of Ontario and a number of specialized administrative tribunals, he is also a Chartered Mediator with a Certificate in Dispute Resolution. Although some matters may be appropriate for litigation, Ted recognizes others may be better suited for alternative dispute resolution. Through effective utilization of alternative dispute resolution techniques and processes, such as collaboration or mediation, his clients may achieve a better solution to their dispute at a lesser cost.

Ted also has a busy family law practice, primarily representing business owners, farmers and professionals in finding effective taxation and financial planning solutions to their family law disputes.

PROFESSIONAL ACTIVITIES:

Ted has been a professional mediator since 1991. He has received a Chartered Mediator designation from the ADR Institute and a Master of Laws degree in Dispute Resolution from York University. Ted is a member of the Ontario Association for Family Mediation and a roster mediator for the Ontario Mandatory Mediation Program.

Ted is also a member of the Canadian Bar Association, the Ontario Bar Association and the Waterloo Region Law Association.

COMMUNITY INVOLVEMENT:

Ted was the Chair of the Board of Directors of CBM Canada for five years, and a former member of the CBM International Board of Directors. He is a past board member of Mennonite Central Committee Ontario (eight years), and has served on various Mennonite Central Committee subcommittees, including its building committee.

Ted has also been a board member of many other community organizations and was a founding member involved in organizing The Collaborative Family Law Association of Waterloo-Wellington, currently known as Best4All. He has also served as a trustee and vice-president of the Waterloo Region Law Association.

Lee has been practicing in the areas of real estate, wills, estates and trusts and corporate and commercial law in the Waterloo Region since his call to the bar in 1979.

Lee's practice involves all aspects of real estate law. He has extensive experience in both residential and commercial real estate development and general real estate law. Lee serves a varied and diverse clientele, including real estate developers, banks, not-for-profit and co-operative housing corporations and individuals. He is committed to ensuring that each client receives personal attention and every matter is completed properly and in a cost effective manner. He believes that it is essential to first understand the client's requirements, and then respond effectively to fulfill these needs, while providing prompt service and well-reasoned advice that is appropriate to the matter at hand.

In addition to his busy real estate practice, Lee is experienced in all estate planning and administrative matters. Within this field, he prepares wills, powers of attorney, trust agreements and related estate planning documents. He regularly advises clients on taxation, establishment and administration of trusts and estates. Lee represents estate administrators and trustees and assists them in respect to their responsibilities in managing and distributing trust and estate assets, including aiding in the winding up of complex estates and filing of related income tax returns.

Lee also practices in the area of corporate and commercial law where he services both for profit and not-for-profit organizations, in connection with a broad range of business and tax driven transactions. He has significant experience in mergers, acquisitions, asset and share transactions, incorporations, reorganizations and commercial real estate matters. Further, he also assists clients with a variety of commercial matters in the areas related to franchising and licensing, financing, technology, labour and employment, shareholder agreements and partnerships. As legal counsel to a number of charitable and not-for-profit organizations and housing co-operatives, Lee effectively advises his clients on such matters as formation, registration and governance.

Lee is a member of the Canadian Bar Association, the Ontario Bar Association and the Waterloo Region Law Association and numerous Mennonite organizations. He has been a past member of the Board of Directors for The House of Friendship Kitchener and Conrad Grebel University College at the University of Waterloo. Lee has also participated as a panellist and speaker in many seminars in the Waterloo Region and other parts of Southern Ontario on topics involving real estate law and estate planning.

David (Dave) Jutzi

Dave has extensive experience in corporate and real estate law matters. He acts for a wide variety of businesses and individuals in a diverse range of industries, including construction materials, manufacturing, health, software, retail and service sectors. Dave also represents a number of not-for-profit organizations, religious institutions and charities within the Waterloo Region in corporate governance and structural issues. He frequently represents clients in the acquisition and sale of office buildings, manufacturing plants and other developed rental commercial property throughout Ontario.

As a respected corporate lawyer and business confidant for many of his clients, Dave assists his clients at all stages of business growth and development. He plays an important role in structuring all aspects of tax and financial planning as well as establishing new ownership relationships including shareholder, partnership, joint venture agreements and other operational arrangements such as licensing and lease agreements.

Dave is a registered trade-mark agent with the Canadian Intellectual Property Office. Working together with his clients, Dave prepares and registers trade-marks with the Canadian and International Trade-Mark offices. He also provides advice to clients relating to the validity and infringement of trade-marks.

Another component to Dave's busy legal practice, is advising his clients on estate planning and administration. He advises individuals respecting will planning, powers of attorney and trust planning in order to achieve their objectives while incorporating appropriate tax minimization strategies.

Richard (Ric) Noll

With extensive experience in all facets of family law and related issues, Ric skillfully assists his clients through the legal process, always conscious of the fact that he is often dealing with emotional and stressful situations. Working together with his clients, Ric will assess what options are available and advise how to best resolve the situation. Separation and divorce can be resolved in various ways. Negotiation, collaboration, mediation and arbitration are all options which may be canvassed. However, if the issues cannot be quickly resolved through such alternative means of resolution, Ric is a seasoned litigator, having appeared before all levels of court in this province.

Ric is experienced in the negotiation and preparation of cohabitation, pre-nuptial and separation agreements as well as paternity plans, surrogate contracts and adoptions. He is also adept in matters relating to child protection, mobility and variation of custody, child and spousal orders and agreements.

In effectively serving the needs of his clients, Ric can also assist with transfers of property, mortgages, wills and powers of attorney. estate planning, administration and litigation is also a growing part of his practice.

Kelly has been an associate member of the firm since 2003. She enjoys a general and diverse practice and services the needs of both private and corporate clients.

Kelly's primary focus is on the resolution of civil disputes, including those related to family law, employment law, estates, and guardianship. She is also actively involved with the co-operative housing sector.

Kelly is approachable, responsive and committed to her clients. She strives to provide each client with the care and timely attention that they deserve. Kelly prides herself in being someone to whom her clients can easily relate. She takes the time to speak to her clients in plain language, keeping each advised every step of the way. Kelly helps them understand and appreciate the various processes and options that are available to them.

While litigation is often necessary, she recognizes that in many cases, alternative methods to resolve disputes best serve her clients. She encourages negotiation, collaboration and discussion, where appropriate, applying an aggressive, but fair approach.

Patrick Clouthier

Patrick is an associate at the firm, practicing primarily in the areas of corporate and commercial law and real estate.

He completed his law degree at the University of Ottawa in 2019. During the course of his legal studies, Patrick leveraged his broad sports knowledge and experience to compete in both the National Hockey League and Major League Baseball arbitration competitions. He was also the vice-president of the Sports & Entertainment Law Society at the University of Ottawa and a Pro Bono Students Canada volunteer at Reach Canada, Equality and Justice for People with Disabilities. Outside of his legal pursuits, Patrick enjoyed playing in numerous competitive volleyball leagues and tournaments in the Ottawa-Gatineau area.

Before joining the firm, Patrick articled at a national full-service firm in the region where he gained exposure to many areas of law through corporate and litigation rotations. Notably, he was involved in analyzing agreements related to shareholders, partnerships, asset and share purchases, licensing, and leases.

Patrick has been a lifelong athlete and continues to stay active through running local trails, golfing, and playing baseball.

Michelle Kumar

Michelle is an associate lawyer at the firm, practicing primarily in corporate and commercial law and real estate law.

Michelle completed her Canadian Juris Doctorate at the University of Windsor and her American Juris Doctorate at the University of Detroit Mercy School of Law, graduating cum laude from both law schools. Michelle is also a registered, licensed social worker with a Masters from the University of Western Ontario.

During her legal studies, Michelle was the teaching assistant for the legal research and writing course for 1L students and was the 2018 Champion of the Patrick A. Keenan Memorial Appellate Advocacy Competition where Michigan Supreme Court judges decided the final round. Michelle was the recipient of the Virginia Leo Sirotnak Scholarship, the E. Lindsay Rogin Memorial Award for female academic achievement, the Helen Norma Laframboise Scholarship for academic excellence.

Michelle also volunteered at a Military Veterans’ Law Clinic supporting veterans in obtaining government benefits and completed a judicial clerkship under the Honorable Judge Mark McConnell at the 18th District Court of Michigan. Michelle also spent time shadowing Justice King at the Ontario Superior Court of Justice and Justice Trotter at the Ontario Court of Appeal.

Michelle joins the firm after having completed her summering and articling with a full-service Bay Street firm in downtown, Toronto where she gained experience and practice in various areas of law through work in corporate and litigation departments. She was involved in the sale and acquisition of businesses, corporate restructures, shareholder and partnership agreements, and general corporate advice regarding numerous legal issues (e.g., employment arrangements, supplier and customer contracts, commercial disputes and mortgages etc.).

Michelle enjoys singing, playing piano, and acting in film and television outside of her legal pursuits.
